I'm reviewing a few Notices of Incompleteness letters in which the loan officer noted that the application was incomplete due to not having signed preliminary documents returned to the Bank. As far as I know, there is not a federal requirement to sign preliminary documents. I could understand if the request was for the Notice of Intent to be returned signed, however, it just states signed preliminary documents.

Thoughts?

FWIW, one application the applicant fell off the face of the earth and would not respond. For the other application, the file is silent on what actually happened.

The regulations don't require almost anything that we as an institution require in order to underwrite an application. If it's your policy to require a signed initial disclosure package in order to underwrite a loan, then I don't see an issue of requiring that for a completed application.
