Marketing wants to start a paper ad campaign for the next 6 weeks in which everyone that signs up for e-statements is entered into a weekly drawing for $50.

Can this be done?

Duchess hit that nail on the head. In a word, "no," you can't do this because that would fall under the definition of a lottery. While it doesn't sound like one, you will see that it is if you look up the definition or search here.

Yeah, I was confident it was, but never hurts to get second and third opinions. The "no purchase necessary or consideration given" would get the bank out of the defintion of a lottery though.

How could it be 'no purchsae necessary' when the customer has to sign up for e-statements? Wouldn't they have to have an account?

No, it's open to anybody. She(the marketing officer) has rules on the drawing. If your not a customer, they can enter by sending in a 3x5 card with certain information on it. It's a drawing for all, but it highlights those in particular that have accounts here and open e-statments- I guess that's the best way to describe it.

I did a search on the 'net for similar type cash drawings and found many banks that did basically the same thing.
