I have recently been informed that ALL real estate transactions in Arizona close through a title company. As a result, closing/settlement/escrow fees are charged in ALL transactions whether they be cash or credit.

Typically, we dislose these types of closing fees as prepaid finance charges. However, if they are paid in comparable cash transactions we could legitimately exclude them. Can anyone confirm for me that settlement/clsoing fees are charged in cash real estate transactions? Is closing through a title company a state law? Industry practice?

Not all real estate transactions in AZ close through a title company. If a person is paying cash for the whole transactions, then they can do the paperwork themselves if they want. Most do choose to go through and pay a title company for the document services.
