We have a situation where we are in the process of trying to obtain e-consent so we can email out loan disclosures to a borrower. The non-borrowing spouse replied to our demonstrate able consent email with the code word. I am hesitant to say they are compliant to email disclosures due to the "borrower" not responding but rather the non-borrower spouse. But if I mail disclosures who's to say the borrower opens the mail either! Any help or guidance would be appreciated!

How do you know it was the non-borrowing spouse that responded?

Regardless, I agree that your borrower has not provided demonstrable consent.
