Respa exempts assumptions. Therefore there are no requirements for HUD-1s for assumptions. Some states also exempt HUD-1s. However, our FHA auditor has stated that the HUD-1 is required for all FHA Assumptions. But they could not specifically show me in their HUD Handbook where it states this requirement. She just stated "it is required, end of discussion". Has anyone run accross this problem, and can FHA require this without written requirements in their handbook?
