We approved a commercial construction loan for a borrower wishing to build a community center. Once approved, the borrower selected a builder. The builder is not a company we had worked with so we had to qualify the builder by going through our normal underwriting process. We were not able to qualify the builder due to poor credit. Even though the builder did not apply for a loan with us, it seems we should send an adverse action notice that includes the FCRA notice. What is the best practice for notifying our borrower who wished to use this builder?
