We recently set a cap on the number NSF items we will charge per day on accounts. When they did this they also did it for business accounts. They have since decided that this will cause too much revenue loss. Does anyone know if there was any recent guidance issued on capping NSF items for business accounts or issues we should be concerned about?

Also are we required to give 30 day notice if your disclosures stated we capped it but we no longer will be going forward?

The regulatory guidance has only focused on what banks do with/to consumer accounts. Businesses are believed to have more bargaining power and a better grasp of pricing practices, apparently. In any event, businesses don't cast ballots in November (he says cynically).

If there is anything that would address business account NSF fees, it's at a state level.

Whether or not you have a notification requirement for business accounts and how many days are required are matters of contract, unless by some rare chance they are addressed in state laws.
