Can we count the cashing or depositing(by the customer) of an interest check paid on a dormant CD as contact?

If they are depositing the checks into an active account at your bank or maintain other active accounts for which you are delivering periodic correspondence, do you not know the location of the depositor? If they are cashing the checks, I'm not too sure about that one. You might have to call the comptroller's office and ask them.

Section 73.101. Inactive Account or Safe Deposit Box
Presumed Abandoned
(a) An account or safe deposit box is presumed
abandoned if:
(1) except as provided by Subsection (c), the
account or safe deposit box has been inactive
for at least five years as determined under
Subsection (b);
(2) the location of the depositor of the account or
owner of the safe deposit box is unknown to
the depository; and
(3) the amount of the account or the contents
of the box have not been delivered to the
comptroller in accordance with Chapter 74.

A few years ago when I went to Austin for training I was told it could be determined as losing contact with the customer. If they had other active accounts you hadn't lost contact with them. However I agree with rlcarey ask Austin just in case.
