I'm working on a filing for counterfeit check activity. Checks were deposited at Megabank. Our customer contacted local LE. Local LE contacted Megabank and obtained address and account information for suspects depositing the counterfeit checks. LE passed along that information to our bank in writing. Am I violating some sort of confidentiality if I include the Megabank customer/suspect information in my filing?

I started to wonder if I was unintentionally tiptoeing in joint SAR territory.

There is no "joint" SAR unless you check the box on the first page and you will not do that until you reach a consensus with the other bank.

Attribute all of the information about the other bank's customer to a disclosure to you by law enforcement. Whether they should have told you is moot...

I have been spending too much time on TRID...I looked at the title of this thread and immediately thought "Why would you include a Loan Estimate in a SAR?"

I do lending compliance and BSA. I was reviewing the lists of my old posts and thought to myself, "I don't remember posting a question about Loan Estimates..." laugh

Law enforcement complains all the time about the acronyms bankers use in SAR narratives. The first time I saw the new SAR and it asked for "LE Contact" I asked myself, "What in the Sam Hill is an LE?" (I had to read the instructions.)
