One of our investors offers a credit on the purchase of a loan from us if they referred the customer that wants to refinance to us and we sell it to them. Would this be a Section 8 issue? They are referring to us for use to originate and sell to them. If we sell this loan to them they provide incentive.

So let me get this straight - they refer a consumer to you and if you make the consumer a loan, they pay you extra if they buy the loan from you?

That seems a little backwards for a Section 8 violation to me.

I guess the value they receive is not losing the servicing asset. They refer existing serviced loan borrowers to us that want to refinance in hopes we will sell them back to them.

Well, Section 8 addresses the payment for referrals. If they are both the referrer and the payor I am just not sure it fits.

I didn't if selling it to them was the us providing value for the referral.
