Are most banks preparing to comply with the Do Not Fax Rules or waiting to see if the compliance date will be pushed back again? Also, are banks getting prepared to get consent from any new business relationships?

Kinda scarry, but I think the silence means nobody is worried about it... that, or they're desparately drafting policies & are too busy to answer...

I can't find anything definitive on one issue: Whether a fax of a form requesting permission to fax qualifies as a solicitation...

We're hopeful that Washington will get the rules changed by July 1 or push back the compliance date. If not, I think everyone will be in a world of hurt. Our departments are asking which road they should take. Not sure what to tell them.

The only reason it isn't in effect now is because it was pushed back. And nothing, or little, was done. I'd prepare for the worst and hope for the best.

We've looked at this, but I don't know that there is sufficient demand. And if an extension is granted, many won't care. So what is the demand to make this cost effective?

Thats true the interest in something would depend on whether it actually is going to happen. According to this link it sounds like a go but now they thinking maybe not...??

I just heard from the ABA that the Junk Fax Protection Act - passed by the Senate, which includes the established business relationship exemption, is supposed to be passed by the House early next week with any hope it will be signed by the pres. before the July 1 effective date. If it makes it by the July 1 date.

If it passes the House and Senate and there is no indication it wouldn't be signed, I wouldn't worry about any enforcement actions and wouldn't change my practices. But I would follow it closely.

Once this rule goes into effect, would it be acceptable to accept an e-mail from the company with the listed fax numbers as permission to fax (in essence an e-signature)?

Based on the new law that may or may not go into effect when the House passes a version, the Senate and House reconcile it and the President signs it, we'll know more of what would be required.
