Okay, we all know that the required service providers need to be on the GFE, but if the title company closes the loan instead of the bank, do we need to have the settlement charge for say the flood determination be listed as payable to that service provider (since we don't do our own determinations) or have it listed as the bank on the HUD1, since the check from the title company will be to us to forward the fees for the service on to the actual service provider? I can't find a specific reference to this one in RESPA other than the GFE, but distinctly remember an examiner explaining that the GFE and HUD1 are to let the customer see where every single dollar went during the whole loan process. Thanks.

Any fee paid to the bank, and not retained by the bank must show who ultimately receives the payment.
