Is a Do Not Call policy required if a bank does not do telemarketing?

If I am understanding everything correctly that has been discussed on these threads, yes.
You have to give your current customers the right to not receive solicitation calls (be put on a bank specific list), and you have to be able to give a copy of your policy to whomever may ask for it.

Our commercial department cold calls on various businesses in the are to discuss if we can assist them now or in the future with any financing. Would these types of calls fall under the definition of telemarketing? I wasn't sure if the Do-Not-Call rules applied only to consumers or businesses as well.

Business phone numbers can't be put on the Federal Do Not Call list, only consumer phone numbers.
I would assume the same for 'in house' do not call policies/lists, but I'm not 100% sure...

The Do Not Call rules apply to residential telephone numbers. Other parts of the FCC rule (such as the Junk Fax rule) apply to all lines.

It is unfortunate that the perspective on DNC has changed due to potential litigation. I would recommend having a policy even if only as a defensive measure, defining what you will/will not do. And train staff enterprise wide in case you get an opt-out request.
