I am in the state of Florida and we have a customer who is presenting a Durable Family Power of Attorney that was drawn up in Wisconsin. Is there any reason we can't except it since it was not prepared in Florida? Thanks for your help.

We had one from NY and we are in PA. I ran it by the bank's attorney. He said in PA, yes we can accept a POA created in another state. You might want to run it by your attorney for Florida law.

One warning I can think of: if you want to use the power of attorney as authority for the agent to execute on behalf of a principal a document that transfers or encumbers real estate, most states require that the form (for example the form of the acknowledgment) of the power of attorney be in the form required by that state for conveyances of real estate in that state.
