It's a fair claim.
His insurance could pay for it, but then he faces the higher premiums and the possibilty of non-renewal. Why should he be responsible for the error or mistake of another?

Wait a minute. I don't claim any knowledge as to the validity of the claim (i.e., whether his home actually was destroyed), but he certainly has every right to take action against Mr. Lidle's estate if Mr. Lidle's insurance company is not settling the claim to his satisfaction. If this had been a non-celibrity truck driver who had destroyed a detached home, I doubt anyone would even think to question the action by the homeowner, even if the driver was, tragically, dead.

They don't have the money? That is not the point...it is about responsibility. The dentist did nothing to cause the situation, why should have have to pay for it. So if I am flat broke and ram into your parked car and destroy it, you would have no problem paying for the replacement, because you have more money than me, because that would be the reasonable thing to do? Fat chance.

For some reason, I thought this was settled after the accident. You mean, he waited all this time to file a claim?? I guess that's my big question.

It really wa snot all that long ago...depending on the investigation, insurance companies squabbles, and when they finally opened the estate up, not might have been either the first or right time to finally take this course.
We don't know what other avenues have already been exhausted.
