Reg E Claim Denied on Friendly Fraud?

Can a Reg E claim be denied to friendly fraud? A friend takes the card and uses it to withdraw cash from an ATM or makes a purchase. The customer knows who made the transactions, but doesn’t want the bank or police to arrest the individual. Does the bank have the right to deny the claim and if provisional credit was given, reverse it?
Outgoing Email Confidentiality Notices

I am trying to locate information or comments regarding the use of a confidentiality notice to be added to all outgoing emails for our bank. I am in favor of this, but need to convince our executive group since it is not a regulation. Do you know where I could look for some back-up responses as to why this would be a good practice to have?
Reuse of Consent

We have customers who are receiving electronic statements on one account (have already provided agreement online that they understand and consent to receiving electronic statements) and then come in at a later date to open a second or third account. May we use the previous consent since the customer is the same, computer being used to access the account is the same and the email address is the same for notification purposes? We have had customers consent again when they open the second and third account and are now receiving lot of negative feedback from the customer. Most importantly they do not understand why we do not automatically set them up for e-statements on their new account since we know them and know they can receive and read our electronic statements.
VISA v. Reg E

Our VISA Check Card department is encountering difficulty trying to figure out how to meet both VISA and Reg E requirements. For example, to initiate a charge back for a duplicate charge or wrong amount, VISA requires consumers to make a good faith attempt to resolve the dispute with the merchant prior to filing a charge back, but our Reg E folks tell us we are in violation of Reg E if we tell the customer this. How do other institutions balance the two when they are not in agreement?
Reg E - Re-debit the Customer's Account?

We understand a Reg E dispute must have a decision made within 45 days of the customer notification. At the 45 day mark, the bank is still waiting on a merchant response so the bank makes a decision to finalize the dispute in the customer's favor since they can't keep it open or deny (no proof). The merchant (after the dispute has been finalized) then supplies documentation that proves the customer performed the transaction, can the bank contact the customer to advise and re-debit the customer's account?
