The new amendment to Reg DD requires disclosures of overdraft charges. Our bank does charge overdraft fees, but we do not offer any type of overdraft protection coverage. Does this new amendment still apply to us?

For purposes of Reg Z, is a residential lot loan to a family trust considered a consumer transaction?
New RESPA Rules - Tolerance for Fees

The new RESPA rules include "tolerance" for fees quoted on the GFE. It states that tolerance is the maximum amount by which the charge may exceed the amount of the estimate. It does not say that there is a limit for a fee to decrease. Is there a penalty if our fees happen to decrease by any amount?
RESPA - Compliance Vs Lender

Requirement to send GFE and ETIL upon application when property is identified; lenders think that property is not identified until there is an accepted offer to purchase, i.e. contract. Compliance feels that when the applicant finds a property that they want to negotiate for, that is the trigger for the disclosures, and the lender should be in contact with the applicant to get the property address. RESPA doesn't define what constitutes the identification of the property. Who is correct, Compliance or Lender?
