We have a business customer who had an employee negotiate their payroll checks a second time. This employee deposited their payroll checks through a mobile channel with their bank over a year ago and then deposited them again.
They cleared our customers account because our duplicate detection only goes back a year. Our customer did not reconcile or review his accounts to notice the duplicate payments and wants to hold the bank responsible. They total about $11k. We already tried returning the checks for duplicate and as expected, they were returned for "Late Return".
I am looking for any input as to how we can recoup the funds? The bank of first deposit (PNC) did take in stale dated checks as well as having their customer not adhere to mobile banking terms. Any input would be appreciated.

What is the timeframe on doing a check adjustment for a item paid twice? Mobile item posted to our customer on March 31, 2022 and then again on May 3, 2022.

We have a customer who pays a company, that company processed the check as ACH and days later deposits the actual check. In this case are we able to return the actual check that cleared secondarily as duplicate item within the 45 or 60 days from statement date?

This is about holds on mobile RDC Deposits, specifically what are the rules on funds availability? For what periods of time are we permitted to hold funds on mobile deposits and is the item itself going to affect this?
Also, pertaining to a legal copy of deposited checks - are we obligated to provide the client with the IRD in a digital bank environment, or just a notice covers us?

We had a check post to a customer's account on 1/28/2021 and they brought to our attention in late February that this check had already paid on the account on 9/28/2020 as an ACH check conversion. It is too late to return either item so how would this be handled? Would we need to get with the ODFI of the ACH to see if they would return the funds to us in good faith?

For the Reg CC RDC indemnity, it states; "(2) A bank described in paragraph (f)(1) of this section shall indemnify, as set forth in § 229.34(i), a depositary bank that accepts the original check for deposit for losses incurred by that depositary bank if the loss is due to the check having already been paid."
We have a customer which is a business offering check cashing and it makes deposits via remote deposit capture. I am confused over the liability and timing of paper vs. electronic deposits, duplicate items and will restrictive endorsements influence liability?
